Report on the personal data protection in accordance with the art. 13 of the L. D. n. 196/2003 According to the Legislative Decree n. 196 from June 30, 2003 (stated as 'the Code'), Vi.Be.Mac. Spa (stated as 'the Company') wishes to inform you that the processing of your data shall be carried out according to the principles of accuracy, legality and transparency in order to protect your privacy and rights. According to the art. 13 of the Code we would like to inform you on the following: Aims of processing (art. 13, letter a) The data resulting from the navigation of the site www.vibemac.com (stated as 'the Site') or otherwise acquired by Vi.Be.Mac from any eventual contractual agreement, shall be processed exclusively for the following purposes: -fulfillment of duties implied by laws, regulations, dispositions issued by the Authorities and Administrative Bodies of Surveillance and Control; -programmation of activities (planning and monitoring of tasks, work load and activities) -client management (managing clients, contracts, orders, shipments and invoice, reliability and solvency control) -suppliers management (managing suppliers, contracts, orders, deliveries and invoice, selection according to company's needs) -dispute management (contract non-fulfillments, recourses, transactions, credit recovery, arbitration, judicial controversy) -services of internal control (of security, production, service quality, patrimonial integrity) -marketing, commercial instruction and promotions, inclusive of newslatter and advertising subscriptions as well as creating commercial profile for the above-mentioned activities -to allow access and navigation on the website, as well as, elaboration of anonymous statistics regarding the site usage in order to control its correct functioning and to ensure the eventual responsibility in case if illicit acts take place during navigation - to provide registration services on the site -to register indications of session 2.Cookies The website, online services, email messages and advertising may use 'cookie' and other technologies such as pixel tag and web beacon. These technologies help to understand better user behavior, indicate parts of the website that are visited and facilitate and evaluate efficiency of advertising and web searches. We treat information collected by cookies and other technologies as non-personal information. Similarly, to the extent that non-personal information is combined with personal information, we treat the combined information as personal information for the purposes of the present Privacy Policy. Vi.Be.Mac. also uses cookies and other technologies in order to record personal information during your navigation of the website, online services, and applications. Our goal in such cases is to make your experience with Vi.Be.Mac. more convenient and personal. Knowing your contact information, product serial numbers, and information about your computer or device helps us to register your products, to personalize your operating system and to provide you with better customer service. If you want to disable cookies, please, check with your browser provider on how to proceed. Since all our websites use cookies, by disabling them you may block some functions or sections. As is true of most websites, we gather some information automatically and store it in log files. This information includes Internet Protocol (IP) addresses, browser type and language, Internet service provider (ISP), referring and exit pages, operating system, date/time stamp, and clickstream data. We use this information to understand and analyze trends, to administer the site, to learn about user behavior on the site, and to gather demographic information about our user base as a whole. Vi.Be.Mac. may use this information in our marketing and advertising services. In some of our email messages, we use a 'click-through URL' linked to content onVi.Be.Mac's website. When customers click one of these URLs, they pass through a separate web server before arriving at the destination page on our website. We track this click-through data to help us determine interest in particular topics and measure the effectiveness of our customer communications. If you prefer not to be tracked in this way, you should not click text or graphic links in the email messages. Pixel tags enable us to send email messages in a format customers can read, and they tell us whether mail has been opened. We may use this information to reduce or eliminate messages sent to customers. 3. Modes of processing (art. 13, letter a) The data processing is carried out automatically by means of instruments and procedures guaranteeing security and privacy even when using more advanced technological means such as internet. Processing is carried out by using paper, electronic, informatic and visual support devices. The processing may include all the operation or group of operations carried even without electronic devices for collection, registration, organisation, conservation, consultancy, elaboration, modification, selection, extraction, comparison, use, interconnection, blocking, communication, distribution, cancellation and destruction of data as outlined in the art. 4, c.1, letter a, and are necessary for the processing in question, including communication and distribution among the individuals as outlined in the relative section of the present circular. Furthermore, such data shall be: -processed in a legitimate and accurate manner -collected and registered for the explicitly outlined and legitimate purposes and used in other areas of data processing in a manner coherent with such purposes -precise and, if necessary, updated -relevant, complete and non excessive for the purposes, for which they are collected or eventually processed -saved in a form that permits identification of a person in question for a period not longer than necessary for the purposes, for which they are collected or eventually processed Every way that the data is processed is according to the art. 11 of the L. D. n. 196/2003. In order to prevent the data loss, illicit or incorrect uses and non-authorised access, the specific security measures shall be applied. The data may be communicated nationally, as well as internationally and in the EC and other countries, where Vi.Be.Mac. operates. 4. Right or duty of data conferment (art. 13, letter b, c) Giving the data that is necessary for the fulfillment of duties stated by the law (ex. anagraphic data for invoicing), regulations and community legislature, as well as, dispositions issued by Authorities nominated accordinly and by Administrative Bodies of surveillance and control, is obligatory. The refusal of data conferment may result in the impossibility to establish or carry out relations, for which such data is necessary. As regarding other data, their conferment is optional. Its lack shall be subject to our case-by-case evaluation and shall determine the subsequent decisions in terms of importance to our organization of the requested and not obtained data. 5.The nature of processed data We will process your anagraphic and fiscal data, economic data necessary for the fulfillment of contractual relations that are already established or will be in the future, as well as, electronic address that will be requested from you and/or provided the first time you receive our services. We do not possess any of your data that is qualified as sensible (art. 4, d) of the L. D. n. 196/2003) or of judicial nature (art.4, e) of the L.D. 196/2003). Processed data: -economic, commercial, financial and insurance activities (accounting data, orders, delivery bonuses, invoices, articles, products, services, contracts, transaction agreements, financial credentials), -names, address or other elements of identification (company name, work address, legal address, telephone, telefax number or email, fiscal code, VAT code), -IP addresses; 6. Personal data security Personal data is protected from the unauthorized access, use or disclosure. Only our stuff in charge can access data by using their personal authentication and all the necessary security procedures have been applied in order to protect data from the unauthorized access locally and via internet. All the personal data conferred to us is, in fact, stored in a secure and surveilled place. For such purposes, we have applied physical, electronic and organizational processes for protection and safeguarding the collected information. 7.Communication and areas of divulgation (art. 13, letter d) The data subject to the present report can be entrusted to third parties in charge and/or responsible for data processing, thus, implying with such term entrusting the entire data processing and management (ex. bookkeeping, salary processing etc). Your data shall not be disclosed, meaning divulgation to unknown individuals in whichever way, even upon their consultation or disposal. As such, we may communicate your data may only to one or several of the following individuals: Individuals that have access to data according to the law, regulation or the community legislature within the limits outlined by such acts System administrator in compliance with the general act from 28.11.2008 of the Guarantor Maintenance managers for our information system and/or the software that we use in case of breakdown or problems with security or processing for the period strictly necessary to recover the function. Individuals who need access to their data for the activities relevant to the connection between us and you in terms that are strictly necessary for such activities (for example, credit institutes, forwarders etc) Our consultants, in terms of the collaboration with our company, upon a prior letter of nomination that implies their obligation to privacy and security External companies, to which we entrust certain operations of the data processing, as outlined under the art 7. Our processing managers for security purposes and whose names are stated under 'The owner and managers' of the present report To the following individuals that may become aware of your data, in the quality of managers or responsible for the processing, as nominated by the executive for processing: executive, administrators and auditors, internal secretary offices, accounting and invoicing clerks, product/service sales clerks, technical assistance clerks. 8. The rights of the party in question (art. 13 letter e) The individuals who confer their personal data have the right at any moment to receive confirmation of existence or less of the relative data and to know contents and origin, verify accuracy or request integration or update or ratification, according to the art 7 of L.D. 196/03. According to the later article, one has the right to ask for cancellation, transformation into anonymous form or block the data that is illicit, as well as, oppose: For legitimate reasons to the processing of data concerning this individual, as well as, to the purposes of collection of such data, In any case to the processing of his personal data for advertising or direct sales, market research or commercial communications. To exercise such right you can turn to the processing manager available on the postal address of our Company or on the email address: privacy@vibemac.com You can turn to the data processing manager to exercise your rights, as outlined in the art. 7, 8, 9 and 10 of the Decree, of which the art.7 states the following: Art. 7. The right to access personal data and other rights 1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form. 2. A data subject shall have the right to be informed a) of the source of the personal data; b) of the purposes and methods of the processing; c) of the logic applied to the processing, if the latter is carried out with the help of electronic means; d) of the identification data concerning data controller, data processors and the representative designated as per the art 5, comma 2; e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State's territory, data processor(s) or person(s) in charge of the processing. 3. A data subject shall have the right to obtain a) updating, rectification or, where interested therein, integration of the data; b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed; c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected. 4. A data subject shall have the right to object, in whole or in part, a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection; b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys. 9. Responsible for processing (art. 13, letter f) Ms. Elena Guerreschi has been nominated as a person responsible for the data processing in the headquarters of Vi.Be.Mac., located in San Giovanni Lupatoto VR (Italy), 37057, via Monte Pastello 7/i.
Having read the report in accordance to the art. 13 of the Code and according to the art 23 and 26 of the later:
